Q: Are your documents prepared by paralegals or actual attorneys?
Our documents are prepared by and reviewed by actual attorneys with several years of experience with divorce and other family law matters. We are able to answer questions that may arise during your divorce and assist you with the filing process through final judgment.
Q: How long does it take to prepare my documents?
Once payment is made through PayPal, we will begin work on your divorce documents immediately. We will contact you if we need additional information to complete your divorce. Usually we will be able to complete your paperwork in less and five business days.
Q: What if my spouse and I are unable to agree on all terms of our divorce?
You will not be able to use our online service if you and your spouse cannot agree on all terms. At that point your divorce will be considered a contested divorce and you may need to seek the advice of an attorney to assist you. We may be able to refer you to an attorney in your area.
Q: What documents do you provide?
For all uncontested divorces, with or without children, we provide the following:
1. Petition for Divorce;
2. Verification;
3. Civil Summons;
4. Domestic Relations Financial Affidavit (if required by Court);
5. Acknowledgment of Service;
6. Consent to Jurisdiction and Venue;
7. Consent to Present Case;
8. Domestic Relations Case Final Disposition Information Form;
9. Domestic Relations Case Filing Form;
10. Rule Nisi;
11. Settlement Agreement;
12. Temporary Order (if required);
13. Final Judgment,
14. Report of Divorce, Annulment or Dissolution of Marriage.
For uncontested divorces with children we provide all of the above documents plus the following:
15. Child Support Worksheet;
16. Child Support Addendum;
17. Parenting Plan (Visitation Schedule).Occasionally some Courts may require special Orders to be filed with the Court. Those documents will be prepared on a case by case basis.
Q. I don't know where my spouse is. Can I still get an uncontested divorced?
Yes you can. You will need to file an Affidavit of Diligent Search detailing the last time you had contact with your spouse and the efforts you have made to find your spouse. You will then need to serve your spouse by public notification in the legal newspaper for your county. This publication usually costs an additional $80.00 made payable to the newspaper of publication.
Q: Are there additional requirements for couples with children?
Yes. If you and your spouse have children together, both of you will be required to attend a Parenting Seminar sponsored and approved by the Court. Proof of completion of this seminar will required before a divorce can be finalized.
